TERMS & CONDITIONS
Strategic Advertising Services & Campaign Implementation Agreement
By engaging, purchasing, or participating in services provided by [Strategic Advertising Ja] (“Company”, “we”, “our”), the client (“Client”, “you”) agrees to the following terms.
1. Nature of Services
The Company provides advertising, campaign setup, creative development, messaging strategy, content guidance, and customer acquisition system implementation.
Services may include:
Advertisement creation
Campaign setup and management
Landing page creation
Lead handling processes
Automated response setup
Content planning and guidance
Optimization and performance refinement
The Company does not operate the Client’s business, sales department, fulfillment, staffing, or internal operations.
The Company provides marketing implementation and communication systems — not business management services.
2. No Guarantee of Results
The Client acknowledges and agrees:
Marketing outcomes vary based on numerous factors outside the Company’s control, including but not limited to:
pricing
service quality
reputation
response time
customer handling
competitiveness of the market
economic conditions
advertising platform policies
client participation
Accordingly:
The Company does not guarantee specific revenue, profit, number of customers, or financial performance.
We implement systems designed to improve visibility, inquiries, and communication clarity.
Business results ultimately depend on how the Client operates and responds to opportunities generated.
3. Advertising Platform Dependency
The Client understands:
All advertising campaigns operate on third-party platforms (e.g., Meta/Facebook, Instagram, Google, etc.). These platforms:
control delivery
control pricing
control reach
may suspend accounts
may reject ads
may change policies at any time
The Company is not responsible for platform outages, restrictions, algorithm changes, account suspensions, ad disapprovals, or cost fluctuations.
Ad spend paid to platforms is separate from service fees and is non-refundable.
4. Client Responsibilities
The success of the campaign requires reasonable cooperation from the Client.
The Client agrees to:
Provide accurate business information
Respond to approvals in a timely manner
Provide requested materials (logos, offers, service details)
Respond to customer inquiries
Maintain professional communication with prospects
Maintain a working contact number or communication channel
Follow recommended response procedures
Failure to participate or respond promptly may affect performance and does not constitute service failure.
5. Timelines
The Company may state estimated timelines such as “14-day launch” or similar activation windows.
These timelines depend on:
client responsiveness
access to required accounts
approval turnaround
platform review times
Delays caused by the Client, third-party platforms, or incomplete information extend timelines without breach of agreement.
6. Creative & Messaging
The Client understands:
Creative work is developed using professional judgment and marketing principles.
Marketing performance can never be predicted with certainty prior to real market data.
Creative preferences (colors, styles, personal opinions) may not correlate with performance outcomes.
The Company reserves the right to make strategic recommendations in the interest of campaign performance.
7. Lead Quality
The Company generates opportunities for communication.
The Company does not control:
who chooses to inquire
customer readiness
customer budget
purchasing decisions
The Company is not responsible for:
unqualified leads
prospects who do not purchase
missed opportunities
conversion rates
Closing customers remains the Client’s responsibility.
8. Automated Systems & Communication Tools
If automated response or messaging systems are implemented:
The Client acknowledges:
automation assists response handling
it does not replace human communication
improper follow-up by the Client may affect results
The Company is not responsible for:
missed messages
customer misunderstandings
internal communication breakdowns
staff handling errors
9. Payment Terms
All fees are for time, expertise, labor, and implementation.
Payments are:
non-refundable once work has begun
not contingent on campaign performance
not contingent on sales results
Installment plans represent a payment convenience and do not convert the service into a performance-based contract.
Failure to complete payment may result in:
suspension of services
removal of active campaigns
revocation of deliverables
10. Refund Policy
Because services involve time, labor, strategy, and creative work:
All payments are non-refundable once onboarding or implementation has started.
The Company does not offer refunds based on:
dissatisfaction with business results
lead volume expectations
subjective preferences
changes in business direction
11. Intellectual Property
Upon full payment, the Client receives usage rights to the final approved advertising materials for their business use.
The Company retains the right to:
display work in portfolio
use campaigns for case studies
reference the Client as a past or current customer
12. Limitation of Liability
To the maximum extent permitted by law:
The Company shall not be liable for:
loss of revenue
loss of profits
missed opportunities
business interruption
advertising platform issues
staff handling errors
customer disputes
indirect or consequential damages
The Client agrees the Company’s total liability, if any, shall not exceed the amount paid for the specific service.
13. Termination
Either party may terminate future services with written notice.
Work already completed and payments already made remain non-refundable.
Upon termination:
campaigns may be paused
systems may be disconnected
ongoing support ceases
14. Acceptance
By submitting payment, signing a proposal, or beginning onboarding, the Client acknowledges they have read, understood, and agreed to these terms.
